How to Write a Cease and Desist Letter to Debt Collectors?


     First, of all you need to structure your letter properly. You need to have your name, address at the top of the letter.   You'll also need the title at the top of the letter in bold and centered.   

    Next, you need too add the name and adress of the company your addressing.   It would also be good to add a re: line to state what the letter is about. 

Then, you too to demand they stop contacting you.  You can do this in any way you like.   According to the Fair Debt Collection Practices.  You have the right to ask them to stop calling you and to choose which method of communication you prefer. 

You can actually do this over the phone when they call you.  You may simply state that you prefer to have all your communication by mail.  You can also state that it is your right due to the FDCPA procedures and since they are in the business of being a debt collectors that statue applies to them. 

When you do this you're letting them know you're aware of why you have the right to demand this from them.

Since November 30, 2021, you can opt out of all collection communications and request to be only contacted by mail. 


You may also simply just state to them that you prefer to be contact by mail. 


Reasons Why a Debt Collector May contact you or not


  • They may contact to you explain that they will no longer be contacting you. 
  • They may stop contact you due to statue of limitations
  • You can also check the state of limitation in your state and include that in your letter.  They may not even have the right to contact you at all. 
  • They failed to validate the debt. 
  • Your Cease and Desist Letter explaining to them to stop contact you, the reasons why, and what will happen if they don't.
